COMPLIANCE WITH SC ORDER ON BENEFITS TO SOLDIERS / VETERANS

 

 

993. SHRI RAJEEV CHANDRASEKHAR:

 

Will the Minister of DEFENCE be pleased to state:

 

(a) whether Government will consider withdrawing pending appeals against cases of disability pension / benefits of soldiers / veterans following its latest order complying with the Hon’ble Supreme Court order of 3rd July, 2013;

 

(b) if so, the timeline by which the appeals will be withdrawn; and

 

(c) if not, the reasons therefor?

(a)  Ministry of Defence have, in compliance of the Hon’ble Supreme Court order of 02.07.2013 in Civil Appeal No.4949/2013 filed by Shri Dharamvir Singh, Appellant, against the order of Hon’ble High Court of Himachal Pradesh, Shimla, issued a letter No.4(17)2015/D(Pen/Legal), dated 29.06.2017 for implementation of orders of Hon’ble Courts / Armed Forces Tribunal’s (AFT’s) in ‘Neither Attributable to Nor Aggravated (NANA)’ by service cases.  Ministry of Defence do not propose to withdraw such pending appeals in Hon’ble Supreme Court.

 

(b)  Does not arise.

 

(c)  It is the considered view of Ministry of Defence to await the orders of the Hon’ble Supreme Court in Civil Appeals filed in ‘NANA’ cases.
