STATUS OF REPORT ON LITIGATION AND ALLIED ISSUES

 

  1. SHRI RAJEEV CHANDRASEKHAR:

 

Will the Minister of DEFENCE be pleased to state:

 

(a)  what is the status of the Report of Expert Committee constituted by the Minister to suggest measures for reducing on litigation and allied issues submitted on 24 November 2015;

 

(b) whether the process of implementation of the report has started, as per the announcement made by Government on 21 August 2016;

 

(c)  if so, the details thereof and if not, the reasons therefor; and

 

(d)  the steps Government has taken to reduce litigation against soldiers?

SUBHASH BHAMRE

 

 

(a) to (d): The Expert Committee submitted its report on 24.11.2015 containing 75 recommendations.  Out of the 75 recommendations, 16 have been accepted for implementation, and another 16 have been accepted in-principle for implementation.

 

8 recommendations have been implemented by the Indian Air Force (IAF).  In addition, Department of Ex-Servicemen Welfare has also implemented 1 recommendation out of 16 accepted for implementation.

 

To reduce litigation, appeals on the orders of Armed Forces Tribunal and Courts are filed only if there is sufficient merit.
